Terms and conditions of sale
Version of 23 October 2026, applicable to any order placed on mielleriedeprovence.com from that date.
1. Identification of the seller
The products presented on the website are sold by the sole trader business ECOMMERCE DYNAMICS, operating the brand Miellerie de Provence (full identity of the seller in the legal notice) — SIREN 823 524 988 — Intra-Community VAT FR11 823 524 988 — Espace Eole, Hall B, 70 rue de la Coquillade, 13540 Aix-en-Provence, France — [email protected].
2. Purpose and scope
These general terms and conditions of sale (the “Terms”) govern distance sales of honeys and hive products made to consumers via the website mielleriedeprovence.com. Any order implies unreserved acceptance of these Terms, which the buyer acknowledges having read before confirming their order. Sales to professionals are subject to specific conditions, available on request.
3. Products
Honeys are presented with their name, net weight, origin (France – Provence), price and price per kilogram. The photographs are as faithful as possible; since the colour and texture of an unpasteurised honey may vary from one harvest to another and the honey may crystallise naturally, such variations do not constitute a lack of conformity. The best-before date (DDM) and the batch number appear on each jar. Honey is not suitable for children under one year of age.
4. Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery charges, which are displayed before the order is finally confirmed. For deliveries outside the European Union, any customs duties and local taxes are payable by the recipient. Miellerie de Provence may change its prices at any time; the applicable price is the one displayed at the time the order is confirmed.
5. Ordering
Ordering takes place in four steps: filling the basket, entering contact details and choosing delivery, checking the order summary, payment. The summary allows any errors to be corrected before confirmation. A confirmation email setting out the details of the order and these Terms is sent to the buyer. Miellerie de Provence reserves the right to refuse an order in the event of a previous dispute, suspected fraud or quantities that are abnormal for a consumer.
6. Payment
Payment is made at the time of ordering by bank card, Apple Pay, Google Pay or Link, via the secure Stripe platform. Bank details never pass through our servers. The order is charged upon confirmation; the products remain the property of the seller until payment has been made in full.
7. Delivery
Orders are prepared in Aix-en-Provence and shipped in a protective parcel within 2 to 3 working days after payment, to metropolitan France and to the European countries listed when ordering. The indicative delivery time is 2 to 5 working days after dispatch within France. Shipping costs are 7 € in France, free for purchases of 50 € or more; for other countries, they are shown when ordering (free from 100 €). If the stated delivery time is exceeded by more than 7 days, the buyer may cancel their order by email and will be refunded within 14 days (Articles L.216-6 et seq. of the Code de la consommation (French Consumer Code)). Risk passes to the buyer when the parcel is handed over; any damaged parcel must be the subject of reservations with the carrier and be reported within 48 hours to [email protected], with supporting photos, in order to be replaced or refunded.
8. Right of withdrawal
In accordance with Articles L.221-18 et seq. of the Code de la consommation, the buyer has a period of 14 days from receipt to withdraw, without giving any reason, by informing us by email or by means of the model form reproduced below. The products must be returned within 14 days of this notification, unopened, in their original packaging, to the seller’s address; return costs are borne by the buyer. The refund, including standard delivery charges, is made within 14 days of the products being received back, using the same means of payment. In accordance with Article L.221-28 of the Code de la consommation, the right of withdrawal cannot be exercised for jars unsealed after delivery, for reasons of hygiene and health protection.
Withdrawal form — For the attention of Miellerie de Provence, Espace Eole, Hall B, 70 rue de la Coquillade, 13540 Aix-en-Provence, [email protected]: I hereby give notice of my withdrawal from the contract for the sale of the goods below: … Ordered on … / received on … Name and address of the consumer: … Signature (if this notice is given on paper): … Date: …
9. Legal guarantees
All products sold are covered by the legal guarantee of conformity and the legal guarantee against hidden defects. As these are foodstuffs, a non-conforming product (a jar broken or leaking on arrival, a product other than the one ordered, honey spoiled before the best-before date shown on the jar) is replaced or, where replacement is not possible, refunded. For any claim, write to [email protected] with your order number and, if possible, a photo of the product; we reply within one working day. Any return costs related to a lack of conformity are borne by us.
In accordance with Article D.211-2 of the Code de la consommation (French Consumer Code), the legal provisions are set out below.
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
- the seller refuses to repair or replace the goods;
- the repair or replacement takes place after thirty days;
- the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or the costs of installing the repaired or replacement goods;
- the lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the goods are returned in working order.
The rights set out above result from Articles L.217-1 to L.217-32 of the Code de la consommation.
A seller who, in bad faith, obstructs the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the Code de la consommation).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the Code civil (French Civil Code), for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
10. Personal data
The data collected are necessary for processing the order and are processed in accordance with our Privacy policy. The buyer has the right of access, rectification, erasure, objection and portability, which may be exercised at [email protected].
11. Complaints, mediation and disputes
In the event of a complaint, the buyer should first contact customer service at [email protected]; a response will be given within 7 working days. In accordance with Articles L.612-1 et seq. of the Code de la consommation, in the event of an unresolved dispute the consumer may refer the matter free of charge to a consumer mediator; the contact details of the competent mediator are provided on request at the same address. These Terms are governed by French law; failing an amicable settlement, the French courts shall have jurisdiction.
12. Archiving
Orders and invoices are archived on a reliable and durable medium for ten years and may be provided on request.
